Terms of Services/ Client Agreement

This Client Service Agreement ("Agreement") is entered into between Confianza ("Company," "we," "our," or "us") and the individual or entity booking or receiving services ("Client," "you," or "your").
By booking or receiving services through Confianza, you agree to the terms set forth below.
1. Services
Confianza provides a variety of lifestyle support services, which may include but are not limited to:

Household assistance

Residential and commercial cleaning
-
Personal assistance
-
Lifestyle and concierge support
-
Childcare assistance (non-medical and within the scope of applicable law)

Elder companionship and assistance (non-medical)
-
Fitness coaching and personal training
-
Seasonal or specialty services
-
Other services offered through our website
Services may change or expand over time.
2. Booking Requests
Submitting a booking request does not guarantee acceptance.
Appointments are confirmed only after approval by Confianza.
We reserve the right to decline or cancel requests based on availability, staffing, safety concerns, location, or operational needs.
3. Client Responsibilities
The Client agrees to:

Provide accurate booking information.

Maintain current contact information.

Keep saved addresses and profile details up to date.

Provide safe and lawful access to the service location.

Disclose known hazards that may affect service delivery.

Secure pets or other animals when appropriate.

Treat Confianza staff with professionalism and respect.
Failure to meet these responsibilities may result in delayed, modified, or cancelled services.
4. Client Account
Clients may create an account through the Confianza website.
Account features may include:

Profile management
-
Saved addresses
-
Booking history
-
Current appointments
-
Payment or wallet preferences
-
Service preferences
The Client is responsible for maintaining the confidentiality of account credentials.
Bookings made through the Client's account are presumed to be authorized by the account holder unless unauthorized access is reported promptly.
5. Payments
Payment is due according to the terms presented at the time of booking.
Confianza may require payment before, at the time of, or after service, depending on the service type.
Failure to make timely payment may result in cancellation of services or suspension of future bookings.
6. Cancellations and Rescheduling
Cancellation and rescheduling are governed by Confianza's separate Cancellation & Refund Policy, which is incorporated into this Agreement by reference.
Applicable fees may apply for late cancellations, missed appointments, or repeated rescheduling.
7. Employees and Authorized Service Providers
Services may be performed by employees or authorized independent contractors acting on behalf of Confianza.
All authorized personnel are expected to follow company policies and professional standards while providing services.
8. Access to Property
The Client authorizes Confianza personnel to enter the designated service location for the purpose of performing requested services during the scheduled appointment.
The Client is responsible for ensuring lawful access to the property.
9. Personal Property
Clients are encouraged to secure valuable, sentimental, confidential, or irreplaceable items before services begin.
Confianza is not responsible for ordinary wear, pre-existing damage, or issues arising from undisclosed defects or unsafe conditions.
Any concerns regarding property should be reported promptly after service completion.
10. Health and Safety
Confianza reserves the right to refuse or discontinue services if conditions are believed to present an unreasonable risk to clients, employees, contractors, or property.
This includes, but is not limited to, unsafe environments, illegal activity, aggressive behavior, or hazardous conditions.
11. Childcare and Companion Services
Where applicable, childcare and companionship services are intended to provide non-medical support only.
Confianza does not provide medical treatment, nursing care, therapy, or emergency medical services unless expressly stated otherwise.
Parents, guardians, or responsible family members remain responsible for providing emergency contact information and any legally required authorizations.
12. Fitness Services
Participation in fitness activities involves inherent risks.
Clients acknowledge that they are voluntarily participating and should consult an appropriate healthcare professional before beginning an exercise program if they have concerns about their health.
Additional waivers may be required for fitness-related services.
13. Communication
By providing contact information, Clients consent to receive communications related to bookings, scheduling, invoices, account updates, and customer service.
Clients who subscribe to marketing communications may opt out at any time. Transactional and service-related communications may still be sent as necessary.
14. Limitation of Liability
To the fullest extent permitted by applicable law, Confianza's liability for claims arising from services shall be limited to the amount paid by the Client for the specific service giving rise to the claim, except where prohibited by law.
Nothing in this Agreement limits rights or remedies that cannot legally be waived.
15. Governing Law
This Agreement shall be governed by the laws of the State of New York.
16. Entire Agreement
This Agreement, together with the Privacy Policy, Terms & Conditions, and any applicable service-specific policies, constitutes the entire understanding between Confianza and the Client regarding the services provided.
